Abstract

La sentencia del TJUE, Comisión/España, ha estimado parcialmente el recurso por incumplimiento, al considerar contraria al DUE la regulación legislativa del régimen de responsabilidad patrimonial del Estado legislador por vulneración del principio de efectividad, en virtud de una serie de requisitos procesales. Se desestima, en cambio, la alegación correspondiente al principio de equivalencia. En esa doble constatación se advierte una complementaria faceta nacional y europea del debate atinente al sentido y alcance de ese principio de responsabilidad, inherente al sistema de los Tratados
