Abstract
The aim of this article is to explain the procedural legitimation granted by the Constitution to the Spanish Premier, by which the Premier can present an unconstitutional appeal. This faculty is recognised by the Constitution as well as by the Organic Law of the Constitutional Court, both of which have made a deeper analysis of its internal legal-politic problematic, on one side, and of the comparative law regarding this matter, on the other.
